Privacy Policy
1. Controller
The person responsible for processing your personal data on this website and in connection with my offers (classes, retreats, online studio) is:
Martina Schaub
Burgfelderstrasse 230
4055 Basel, Switzerland
Email: martina.schaub@hotmail.com
Website: www.martinaschaub.com
2. Principles
Protecting your personal data is important to me. I process personal data carefully, confidentially and in accordance with the Swiss Federal Act on Data Protection (FADP). Where applicable, I also take the EU General Data Protection Regulation (GDPR) into account, for example if you live in the EU or take part in a retreat in the EU.
3. Visiting the website
You can visit this website without providing any personal information. For technical reasons, the hosting provider automatically collects certain information when you visit, for example:
IP address
date and time of access
pages visited
browser type and operating system
referrer URL
This data is used to provide the website and to keep it secure and stable. I do not use it to identify you personally.
4. Hosting and forms (Squarespace)
This website is built and hosted with Squarespace (Squarespace, Inc., USA). The online studio also runs on Squarespace. Squarespace processes technical connection data, the information you submit through forms on the website (e.g. contact or registration form), and your account and order data in the online studio. You can find further information in the Squarespace Privacy Policy.
5. Cookies and analytics
This website uses cookies that are necessary for its operation and functionality. Squarespace uses technically necessary cookies to provide the website, keep it secure and enable basic functions. To understand how the website is used, I use Squarespace Analytics. Squarespace collects information such as pages visited, time spent on the site, where visits come from, and device and browser, and provides me with this information in aggregated form. Apart from this, I do not use any analytics, marketing or advertising tracking.
When you first visit the website, a cookie banner informs you about the use of cookies. You can also set your browser to restrict or delete cookies. This may limit the functionality of the website.
6. Contacting me
If you contact me via the contact form or by email, I use your information solely to handle your enquiry.
7. Registration, booking and payment
When you register for a class or retreat, I process the information required for this, such as your name, address, email, phone number and payment details. I use it to process your booking, to communicate with you about the offer and for accounting purposes. Retreats are paid by bank transfer. In the online studio, you pay by credit card via Squarespace Payments or via PayPal. These providers process the payment directly. I do not receive your full credit card details.
Where necessary to run a retreat, I share your name and contact details with partners involved, such as the accommodation, catering or other teachers.
8. Health information
For a safe yoga practice, I ask you to tell me about any health limitations, such as injuries, surgery, chronic conditions or pregnancy. This information is voluntary and is considered sensitive personal data.
I use it solely to adapt the practice to your needs. I share it only with the teachers of the class or retreat concerned and delete it once it has ended.
9. Newsletter and waiting list (Mailchimp)
If you sign up for my newsletter or the waiting list for the online studio, I use your first name and email address to keep you informed about news, classes, retreats and the opening of the online studio. This is based on your consent. After signing up, you will receive an email asking you to confirm your subscription (double opt-in). Only then is your subscription complete. You can unsubscribe at any time using the link in every email.
I use Mailchimp, a service of Intuit Inc., USA, to send emails. Mailchimp stores your details and records whether emails are opened and which links are clicked. I use this information only to improve my newsletters. You can find further information in the Intuit/Mailchimp Privacy Statement.
10. Photos and videos
Photos and videos are sometimes taken during classes and retreats, for example by me or a commissioned photographer. I use them to present my offers on the website, in newsletters and on social media.
I only publish images in which you can be recognised with your consent, which I obtain on site. If you do not wish to be photographed or filmed, please let me know at the start. You can withdraw your consent at any time. I will then remove the images concerned as far as possible. Complete deletion is not always possible for social media posts that have already been shared.
11. Sharing with third parties
I do not sell your data. I only share it where this is necessary to provide my offers, where you have given your consent or where there is a legal obligation. Possible recipients are:
Squarespace (website, hosting, forms)
Mailchimp (newsletter and waiting list)
partners involved in a retreat (accommodation, catering, other teachers, commissioned photographers)
my bank (payment processing)
Squarespace Payments and PayPal (payments in the online studio)
12. Transfer of data abroad
Squarespace, Mailchimp and PayPal are based in the USA or belong to groups based in the USA. Your data may therefore be transferred to the USA. These transfers are based on the following safeguards:
Squarespace (incl. Squarespace Payments): certification under the Swiss-U.S. Data Privacy Framework, supplemented by standard contractual clauses and a data processing agreement
Mailchimp: certification under the Swiss-U.S. Data Privacy Framework
PayPal: Binding Corporate Rules as well as the Data Privacy Framework or standard contractual clauses
If a retreat takes place abroad, I share the necessary information with partners in the country concerned, for example in Portugal. Under Swiss law, EU countries provide an adequate level of data protection.
13. Retention
I keep booking and accounting records for the statutory period of 10 years. I delete health information once the class or retreat concerned has ended. I delete all other data as soon as it is no longer needed for its purpose or you withdraw your consent.
14. SSL/TLS encryption
For security reasons, this website uses SSL/TLS encryption. Data you send to me is therefore transmitted in encrypted form.
15. Your rights
Under applicable data protection law, you have in particular the right to:
information about the personal data I process about you
correction of inaccurate data
deletion of your data, unless there is a statutory retention obligation
restriction of processing, where provided for by law
receive your data in a common electronic format
withdraw any consent you have given, with effect for the future
If you have any questions about data protection, you can contact me by email at any time. You also have the right to lodge a complaint with the Federal Data Protection and Information Commissioner (FDPIC).
16. Changes
I may update this privacy policy at any time. The version published on this website applies. In the event of any discrepancy between the language versions, the German version shall prevail.
